An ‘investment professional’ is defined to include:

an authorised person (this will include banks, stockbrokers, securities houses, investment managers, insurance companies and financial intermediaries);

a person who is exempt from the requirement for authorisation under the Financial Services and Markets Act 2000 (‘FSMA‘) (this will include appointed representatives of authorised persons, The Bank of England, central banks of other EEA States, The European Central Bank and the International Monetary Fund);

An eligible counterparty is defined to include:

a credit institution;

an insurance company;

a collective investment scheme authorised under the UCITS Directive or its management company;

a pension fund or its management company;

another financial institution authorised or regulated under 2EU2 legislation or the national law of an EEA State
-
an undertaking exempted from the application of MiFID under either Article 2(1)(k) (certain own account dealers in commodities or commodity derivatives) or Article 2(1)(l) (locals) of that directive;
-
a national government or its corresponding office, including a public body that deals with the public debt;
-
a central bank;
-
a supranational organisation.
Persons who do not meet these criteria cannot proceed any further and must leave the website or select another investor-type suitable and appropriate to their own circumstances.
